SOUTH WEST SURF HOUSE – TERMS & CONDITIONS

Dear Surf House Guest,

We’re not massive fans of long Terms and Conditions either. We prefer carefree living and trust between people. That’s what built South West Surf House and what continues to guide us.

That said, we are a small, seasonal surf house with limited availability each week. The terms below are here to keep things clear and fair for everyone.

1. Closing Contracts and Making Bookings

All reservation requests must be made in writing via email or our booking form.

A booking becomes confirmed once a 20% deposit has been received and written confirmation has been issued by SOUTH WEST SURF HOUSE.

The remaining 80% balance is due 30 days prior to arrival.

If the balance is not received by the due date, SOUTH WEST SURF HOUSE reserves the right to cancel the booking and retain the deposit.

Bookings are subject to availability.

Unpaid reservations or unanswered confirmations may be cancelled after one week.

Prices and services confirmed on the customer invoice apply, even if they differ from those later displayed on the website.

Guests must be at least 18 years old to book unless written parental consent is provided.

2. Insurance and Travel Documents

We strongly recommend that all guests obtain comprehensive travel insurance covering cancellations, medical expenses, repatriation, and surf-related activities.

Guests are solely responsible for ensuring their insurance covers surfing and other physical activities.

All required travel documents (passport, visa, entry requirements) are the sole responsibility of the guest.

3. Payment Conditions

A 20% deposit is required to secure a booking.

The remaining 80% balance is due 30 days prior to arrival.

By confirming a booking and providing payment details, the guest authorises SOUTH WEST SURF HOUSE to charge the card on file for:

• Any unpaid balance due

• Damages to property or equipment

• Loss of items

• Unpaid services incurred during the stay

If a guest fails to settle their balance, SOUTH WEST SURF HOUSE reserves the right to charge the card provided at booking. Guests will receive written confirmation of any such charges.

4. Cancellations and Rebookings

All cancellation requests must be submitted via email. The cancellation period is defined by the date the request is received.

The following percentage of the total booking amount will be retained:

More than 30 days before arrival

Full refund of all payments made, minus any non-refundable payment processing fees charged by the payment provider.

Between 15 and 30 days before arrival

20% retained.

Between 8 and 14 days before arrival

50% retained.

7 days or fewer before arrival

100% retained.

No refund will be given in the case of no-shows.

No refund will be given for unused nights, early departure, or late arrival.

All rebookings are subject to availability. Standard cancellation terms apply to rebooked stays.

If SOUTH WEST SURF HOUSE is able to resell a cancelled booking, we may, at our discretion, refund part of the retained amount (minus payment processing fees).

5. Cancellation by SOUTH WEST SURF HOUSE

SOUTH WEST SURF HOUSE reserves the right to cancel a booking in extraordinary circumstances where the booked service cannot be safely or reasonably provided.

In such cases, payments made will be refunded. No compensation will be made for additional costs such as flights or travel arrangements.

6. Force Majeure

SOUTH WEST SURF HOUSE shall not be liable for failure to perform obligations where such failure results from events beyond reasonable control, including but not limited to:

• Natural disasters

• Severe weather conditions

• Government restrictions or travel bans

• Public health events

• Transport disruptions

• Strikes

• Acts of third parties

In such cases, SOUTH WEST SURF HOUSE may offer a date transfer or refund at its discretion, limited to the amount paid for the booking (minus non-refundable payment processing fees).

7. Disclaimer and Assumption of Risk

Surfing and ocean activities involve inherent risks.

By participating in activities organised or facilitated by SOUTH WEST SURF HOUSE, guests acknowledge and accept these risks and participate at their own responsibility.

SOUTH WEST SURF HOUSE shall not be liable for injuries, accidents, illness, death, loss or damage arising from participation in activities, except where required by applicable law.

Guests are responsible for informing SOUTH WEST SURF HOUSE of any medical conditions that may affect participation.

8. Equipment and Property

Bicycles, skateboards and surfboards may be provided for guest use.

Use of equipment is at the guest’s own risk.

Guests are responsible for loss, theft or damage to equipment while in their care.

In the event of loss, theft, or irreparable damage due to negligence, a replacement fee of €150 will apply for bicycles.

Guests are responsible for damage caused to property, furnishings or equipment belonging to SOUTH WEST SURF HOUSE.

SOUTH WEST SURF HOUSE is not responsible for loss or theft of personal belongings.

9. Exclusion of Participation

Guests must follow staff instructions.

If a guest behaves in a manner that endangers themselves, other guests, staff, or the reputation of SOUTH WEST SURF HOUSE, the company reserves the right to terminate the stay without refund.

10. Data Usage and Protection

Guests may be photographed or filmed during their stay for promotional purposes.

Guests consent to the use of such material unless they notify SOUTH WEST SURF HOUSE in writing.

Personal data is handled confidentially and in accordance with applicable data protection regulations. Guests may request removal of marketing consent at any time via email.

11. Ineffectiveness of Individual Provisions

If any provision of these Terms & Conditions is deemed invalid, the remaining provisions shall remain in full effect.

12. Governing Law

These Terms & Conditions are governed by French law. The competent courts shall be those of France.
